This document constitutes a legally binding agreement between you ("User," "Client," "you") and Rose Massage Therapy LLC, including any of its affiliates or DBAs such as "Rose Massage Therapy & Float Spa" (collectively, "the Company," "we," "us").

BY ACCESSING OR USING OUR WEBSITE, BOOKING AN APPOINTMENT (ONLINE, BY PHONE, OR IN-PERSON), OR ENTERING AND USING OUR FACILITIES LOCATED IN COLORADO, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO BE BOUND BY ALL TERMS, CONDITIONS, AND NOTICES CONTAINED HEREIN, INCLUDING THE ASSUMPTION OF RISK AND COMPLETE WAIVER OF LIABILITY.

If you do not agree to these terms, you must not use our website, book services, or use our facilities.

1. Nature of Services The Company provides therapeutic massage, floatation therapy, and related wellness services. You understand that these services are for the purpose of stress reduction, relief from muscular tension, and promoting a state of relaxation. Our practitioners are not medical doctors and do not diagnose illness, disease, or any other physical or mental disorders. The services provided are not a substitute for medical examination, diagnosis, or treatment.

2. Assumption of Inherent Risks You understand and acknowledge that participation in massage therapy, floatation therapy, and use of the Company's facilities carries inherent risks. These risks include, but are not limited to:

• Massage Therapy: Muscle soreness, minor bruising, temporary exacerbation of pre-existing but unknown conditions, and skin reactions to oils or lotions.
• Floatation Therapy: Slipping and falling on wet surfaces, skin irritation from Epsom salts (magnesium sulfate), claustrophobia, disorientation, and accidental ingestion of salt water.
• General Facility Use: Slips, trips, and falls on any premises owned or operated by the Company.

You voluntarily and knowingly assume all such risks, both known and unknown, even if arising from the negligence of the Company or others, and assume full responsibility for your participation.

3. Health & Client Responsibility You agree to fully disclose any and all health conditions, medications, injuries, and allergies on your client intake form. It is your responsibility to keep the Company's practitioners updated on your health status. You affirm that you are in suitable physical and mental condition to receive the services you have booked. You agree to communicate any discomfort, pain, or concerns to your practitioner immediately during your session.

4. RELEASE, WAIVER, AND DISCHARGE OF ALL LIABILITY In consideration for being permitted to use the website, book services, and use the facilities of the Company, YOU HEREBY AGREE TO RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Rose Massage Therapy LLC and Rose Massage Therapy & Float Spa, their officers, members, managers, employees, agents, independent contractors, and representatives (hereinafter the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever, direct or indirect, arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any property belonging to you, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted.

5. Indemnification and Hold Harmless You agree to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of your involvement with the Company, and to reimburse them for any such expenses incurred.

6. Governing Law This agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any legal action or proceeding arising under this agreement will be brought exclusively in the federal or state courts located in Pueblo County, Colorado.

7. Severability If any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

8. Acknowledgement of Understanding You acknowledge that you have read this entire Terms of Use & Liability Waiver, that you fully understand its terms, and that you are GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. You acknowledge this agreement freely and voluntarily and intend by your action (use of website, booking, or use of facilities) for this to be a complete and unconditional release of all liability to the greatest extent allowed by law.

YOUR USE OF THE WEBSITE, THE ACT OF BOOKING A SERVICE, OR YOUR PHYSICAL PRESENCE AT OUR FACILITIES SERVES AS YOUR VOLUNTARY AND BINDING AGREEMENT TO THE TERMS OUTLINED ABOVE.
